Terms and Conditions of Rental

Effective from October 2026. This English translation is provided for information only; in the event of any discrepancy, the French version shall prevail.

Article 1 – Purpose

These terms and conditions apply to all bookings of Villa Theolina, 128 avenue du Sidobre, 81100 Castres, France, made on the theolina-location.fr website. They are entered into between THEOLINA, a French property company (société civile immobilière) with a share capital of €100, SIREN 939 891 495, registered office 15 rue des Pins, 81100 Burlats (hereinafter “the Owner”), and any person aged 18 or over making a booking (hereinafter “the Guest”). The rental is a furnished seasonal holiday let (Article 1713 of the French Civil Code); the premises may not be used as a main residence.

Article 2 – Booking

The booking is confirmed once the deposit has been paid online and these terms and conditions have been accepted by ticking the box provided. A confirmation email sets out the dates, the number of guests and the price. The Guest declares that they are 18 or over and are booking for a leisure stay.

Article 3 – Price

Prices are shown in euros and include all charges: water, electricity, heating, air conditioning, bed linen and 4 towels per bedroom for all 5 bedrooms, and Wi-Fi. End-of-stay cleaning (€90) and the tourist tax are added; the tourist tax is due for each adult at the rate in force in Castres and is paid over to the municipality. Extra beds may be added as an option for more than 12 people, at €15 per bed per night, bed linen included. The price confirmed at the time of booking is final.

Article 4 – Payment

30% of the total price is paid at the time of booking, by bank card via the secure Stripe platform, as adeposit (“arrhes”) (Article L.214-1 of the French Consumer Code). The balance (70%) is paid online no later than 5 days before the arrival date, via the secure payment link emailed to the Guest (or by bank transfer, with the Owner’s prior agreement). For bookings made less than 5 days before arrival, the balance is payable immediately. If the balance is not paid within this period, the Owner may refuse access to the premises and the deposit will be retained.

Article 5 – No right of withdrawal

In accordance with Article L.221-28 12° of the French Consumer Code, the right of withdrawal does not apply to accommodation services provided on a specific date. Any confirmed booking is therefore final.

Article 6 – Cancellation by the Guest

Any cancellation must be notified in writing to [email protected]. In the event of cancellation, whatever the date, the deposit paid is retained by the Owner. No other sum is due. A shortened stay or late arrival does not give rise to any refund. If the Guest does not arrive on the scheduled day without giving notice, the Owner may make the villa available to others from 12 noon the following day.

Article 7 – Cancellation by the Owner

If the Owner cancels the booking, except in cases of force majeure, the Owner will refund the Guest twice the amount of the deposit paid, in accordance with Article L.214-1 of the French Consumer Code.

Article 8 – Force majeure

By way of exception to Articles 6 and 7, the deposit is refunded in full, without any further compensation, if the stay cannot take place for one of the following reasons, occurring after the booking and duly supported by evidence:

  • natural disaster, flood, fire or storm making the villa uninhabitable or inaccessible;
  • an administrative decision preventing the stay: travel ban, lockdown, administrative closure or dangerous building order;
  • death of the Guest, their spouse or partner, a child, a parent, a brother or a sister within the 30 days before arrival;
  • unplanned hospitalisation of the Guest or their spouse, upon presentation of a hospital admission certificate;
  • damage (water damage, major breakdown, fire) making the villa unusable for reasons attributable to the Owner.

The following do not constitute force majeure: a change of plans, bad weather, an illness not requiring hospitalisation, cancellation of the event planned by the Guest, a strike or a transport delay. Guests are advised to take out cancellation insurance with the insurer of their choice.

Article 9 – Arrival and departure

Arrival from 4 pm, departure by 11 am at the latest, unless otherwise agreed in writing in advance. Key handover arrangements are provided before arrival.

Article 10 – Capacity and occupancy

The villa accommodates 12 people, babies included, and a maximum of 15 people with the extra beds booked as an option (one extra bed per person beyond 12, up to a maximum of 3). This maximum may not be exceeded, including for day visitors, without the Owner’s written consent. Subletting or transferring the stay is prohibited without written consent. Pets are welcome free of charge; the Guest is responsible for their behaviour and any damage they cause.

Article 11 – Parties and events

Any event (birthday, christening, seminar, party) must be declared at the time of booking and requires the Owner’s written consent. The Guest undertakes to respect the peace and quiet of the neighbourhood, especially between 10 pm and 7 am; amplified music outdoors is prohibited after 10 pm. In the event of serious disturbance or exceeding the capacity, the Owner may terminate the stay without a refund.

Article 12 – Swimming pool

The swimming pool is not supervised. It is fitted with a safety device in accordance with the law (Articles L.134-10 et seq. of the French Construction and Housing Code). Children must be constantly supervised by, and remain the responsibility of, an adult. The Owner accepts no liability for any accident resulting from a lack of supervision or improper use.

Article 13 – Guest’s obligations

The Guest undertakes to occupy the premises peacefully and in accordance with their intended use; not to rearrange the furniture; not to smoke indoors; to report any damage without delay; to raise any complaint about the condition of the premises within 48 hours of arrival; and to leave the villa tidy, with the washing-up done and the bins emptied. Repairs made necessary by the Guest’s negligence are at the Guest’s expense, and the Owner may claim the replacement value of any damaged or missing items on the inventory.

Article 14 – Insurance

The Guest must be insured against rental risks (fire, water damage, third-party liability) through their home insurance or holiday insurance, and be able to provide proof on request.

Article 15 – Security deposit

No security deposit is currently required. Any damage, loss or repair costs noted during the check-out inspection remain payable by the Guest and will be invoiced to them.

Article 16 – Check-in/check-out inspection and inventory

An inspection report and inventory are drawn up on arrival and departure. If they are carried out by the Owner alone, the Guest has 48 hours to dispute them; failing this, they are deemed accepted.

Article 17 – Personal data

The data collected is processed in accordance with our privacy policy.

Article 18 – Disputes

These terms and conditions are governed by French law. In the event of a dispute, the Guest must first send a written complaint to [email protected]. Failing an amicable settlement, the dispute will be referred to the competent court (tribunal judiciaire), in accordance with the rules applicable to consumers.
